In your complaint you must present, in writing, the following information in its entirety:
  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is being infringed;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material that is allegedly infringing;
  • The complaining party's address, telephone number and email address;
  • A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed pursuant to the DMCA Act (17 U.S.C. § 512(c)(3)

Bookry will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws. Upon receipt of notices complying or substantially complying with the DMCA, Bookry may act expeditiously to remove or disable access to any material claimed to be infringing. Repeat infringers of third-party copyrights are subject to termination in appropriate circumstances.

In assessing whether or not a Bookry user has violated your copyrights, please keep in mind that Bookry is often used within educational estabishments and please keep in mind the “Fair Use” doctrine incorporated into the Copyright Act of 1976, 17 U.S.C. § 107.
